HC extends protection to Sameer Wankhede till June 23

Photograph:ANI Photo The CBI's case is that Wankhede and four other accused had demanded Rs 25 crore bribe from actor Shah Rukh Khan for not framing his son Aryan Khan following alleged seizure of drugs from a cruise ship in October 2021. A division bench of Justices A S Gadkari and S G Dige said it would hear Wankhede's plea seeking to quash the Central Bureau of Investigation's (CBI) FIR in the case on June 23. Wankhede's counsel Aabad Ponda told the HC that as per court's earlier direction, the Indian Revenue Service (IRS) officer appeared before the CBI for interrogation seven times and has been cooperating. CBI's advocate Kuldeep Patil told the court that the investigation in the case was at a crucial stage. The bench said it would hear Wankhede's plea on June 23. "Interim relief granted stands extended till the next date," the court said. Wankhede moved the HC last month seeking quashing of the case and also sought interim protection from any coercive action. A vacation bench of the HC then granted interim protection to Wankhede from arrest till June 8 and directed him to cooperate with the investigation. The CBI in its affidavit filed last week sought for the interim protection to be recalled, saying it had a prima facie case against Wankhede. A public interest litigation (PIL) has been filed in the Bombay High Court seeking to make actor Shah Rukh Khan as an accused for allegedly giving a bribe in order to save his son Aryan Khan. The PIL will be heard on June 20, 2023. The plea states the Central Bureau of Investigation (CBI) filed an FIR against former Narcotics Control Bureau (NCB) Mumbai zonal director Sameer Wankhede for accepting a bribe of Rs 50 lakhs to favour Aryan Khan in the 2021 Cordelia cruise drug bust, reported India Today. It seeks the use of Narco analysis and lie detector tests to bring out the truth. The plea cites Section 12 of The Prevention of Corruption Act, which states if any person gives a bribe to any officer without informing the Anti-Corruption Bureau about getting any favour from the said public servant in his official capacity, then such person is liable for prosecution. It sought prosecution against Shah Rukh Khan and Aryan Khan. It further seeks the transfer of investigation from the CBI to a Special Investigations Team and action against Mumbai Police officials who conducted an inquiry and gave a clean chit to Sameer Wankhede and others from the charges of corruption and misusing public machinery, property and resources for unauthorised purposes to save the accused. Sameer Wankhede tells Bombay high court; Probe team suppressed info to give clean chit to Aryan Khan

MUMBAI: Sameer Wankhede, a former Narcotics Control Bureau (NCB) officer under probe for extortion and bribery, told the Bombay high court that a special enquiry team (SET) sought to give a clean chit to Aryan Khan, son of actor Wankhede said this during the hearing of his petition to quash an FIR registered by the CBI against him for allegedly extorting money to let Aryan Khan off. The SET set up by NCB had alleged that Wankhede added Aryan Khan and a friend Arbaaz Merchant’s names in the case at the last minute. Eventually, after his arrest, the NCB dropped all charges against Aryan. Wankhede said, “The entire endeavour of the SET was to create many doubts regarding the investigation of the Cordelia Cruise case to meet their ultimate motive of giving Aryan Khan a clean chit and be able to justify the same.” Wankhede said it was one of the rarest cases of high-handedness by the agencies to make him a scapegoat. The HC has posted the matter for hearing on June 23. Wankhede also denied allegations of not maintaining documentation on the seizure of a phone from Aryan and said SET was making a frivolous observation to justify its clean chit to the youth. The purported chats between Wankhede and SRK found its way to the media last week despite the matter being sub judice. In the screenshots of chats accessed by India Today, Shah Rukh Khan purportedly urged Wankhede, who was probing the drugs case involving Aryan Khan at that time, not to let Aryan be in jail as it would "destroy his spirit".
